Opponents successfully blocked the JM Architects designed scheme in 2012 a loss of green space but if the private bill is approved Edinburgh City Council will finally be able to proceed.
The £41m school has been in planning for over a decade and will replace a dilapidated 1960’s facility elsewhere in the city.
Campaigners argued that the park was common good land, automatically precluding any development, but it could yet gain the go-ahead if approved on appeal.
Portobello is currently the city’s largest school and would boast a 25m pool and all-weather sports pitches if completed.
